Terms & Conditions

These Terms & Conditions govern your access to and use of services provided by TheEmissaryAgency LLC, a Colorado limited liability company. By engaging our services, signing a Statement of Work (SOW), or using this website, you agree to these terms.

Emissary provides Shopify conversion-rate optimization (CRO), creative production, landing page design, A/B testing, and related services. The specific scope, deliverables, timelines, and fees are defined in the SOW or proposal applicable to your engagement.

Unless stated otherwise in writing, all fees are billed in advance, due upon receipt, and non-refundable except as expressly described in our Refund Policy. Late payments may result in suspension of services and accrue interest at the maximum rate permitted by Colorado law.

You agree to provide timely access to your Shopify store, brand assets, approvals, and any other resources reasonably required for Emissary to deliver services. Delays caused by missing approvals or assets do not change the agreed-upon fees.

Upon full payment, you receive ownership of final deliverables produced specifically for your brand. Emissary retains rights to its underlying methodologies, frameworks, internal tooling, templates, and pre-existing IP.

Each party agrees to keep confidential information shared during the engagement private and to use it solely for the purpose of fulfilling the SOW.

To the maximum extent permitted by Colorado law, Emissary's aggregate liability arising out of or related to the services shall not exceed the fees paid by the client in the three (3) months immediately preceding the claim. In no event shall Emissary be liable for indirect, incidental, or consequential damages.

These Terms are governed by the laws of the State of Colorado. The parties submit to the exclusive jurisdiction of the state and federal courts located in Denver County, Colorado for any dispute arising under these Terms.
